FinCEN Residential Real Estate Reporting Rule Takes Effect This Sunday

The Financial Crimes Enforcement Network (FinCEN) Residential Real Estate Reporting Rule takes effect this Sunday, March 1, 2026. Under the Rule, a reporting person must file a Real Estate Report with FinCEN for certain non-financed transfers of residential real property where at least one transferee is a non-natural person. The reporting obligation will, in most covered transactions, fall to the settlement agent or title insurance professional involved in the closing.
