Legislative Update: May 20-25, 2025

As the 2025 Regular Session of the Alabama Legislature comes to a close, we’re providing this final update on legislation relevant to probate courts, property transfers, and the title industry. Several local bills have now completed the legislative process, while others did not advance.

2025 Legislative Session

Here’s where things stand:

House Bills

  • HB300 (Choctaw County – Probate Court Filing Fees): Signed into law.
  • HB348 (Russell County – Probate Recording Fee Update): Enacted.
  • HB428 (Houston County – Tax Sale and Redemption Procedures): Enacted.
  • HB539 (Randolph County – Probate/Commission Transaction Fee): Enacted.
  • HB545 (Escambia County – Probate Court Fees Adjustment): Indefinitely postponed and did not pass.

Senate Bills

  • SB106 (Small Estates – Threshold for Summary Distribution)
  • SB240 (Coffee County – Judge of Probate Qualifications)
  • SB329 (Lee County – Revenue Commissioner Tax Sale Authority)

These Senate bills saw no additional movement before the end of the session.
