State lawmakers are stepping up efforts to combat deed theft—and the momentum is expected to accelerate in 2027.

States including Arizona, Texas, New York, Illinois, California, Florida and Virginia have enacted measures designed to prevent fraudulent property transfers or help victims reclaim their property.

The approaches vary, but the direction is clear. Lawmakers are looking at stronger identity-verification requirements, tighter notary standards, property-owner notification systems, suspicious-document reviews and faster legal remedies for victims.

In 2027, deed theft legislation is likely to be introduced in at least eight more states including Colorado, Oregon, New Jersey, Florida, Tennessee, Pennsylvania, South Carolina and North Carolina.

These proposals could create new responsibilities for title professionals, settlement agents, notaries and county recorders. Is your company prepared for the operational and compliance changes that may follow?
